Article 1 Introduction

1. These Individual Terms apply to all actions taken by Members when using "Xissmie," an SNS function operated by the Company in "Xfolio" (hereinafter referred to as "this SNS"; this SNS uses "Misskey" (https://misskey-hub.net/ja/), an open source distributed microblogging platform project). Unless otherwise defined in these Individual Terms, the terms used in these Individual Terms shall be defined the same as those in the General Terms.
2. By using this SNS, Members are deemed to have agreed to all of the contents of these Individual Terms and Conditions and the "Misskey" precautions at the time of using this SNS. "Misskey" precautions may change from time to time. Please be sure to check the "Misskey" website for the latest precautions. The following links are reference links regarding "Misskey" precautions.

3. For any matters not specified in these Individual Terms and Conditions, the Universal Terms and Conditions and any guidelines separately established by the Company will apply, unless expressly excluded from application in these Individual Terms and Conditions.

Article 2 Definitions

The definitions of the terms used in these Individual Terms shall be as set forth in the following items. The SNS shall be included in the "Service" as set forth in the Universal Terms, the function that allows users to post on the SNS shall be included in the "Posting Function" as set forth in the Universal Terms, and all information posted by users on the SNS shall be included in the "Posted Information" as set forth in the Universal Terms.

1. "Xissmie Account" refers to the right to use this SNS granted to users who have completed the start-up procedures specified by our company.
2. "Xissmie User Page" refers to a dedicated website that can be used by each User, where procedures related to this SNS can be carried out, and where users can confirm and change their registration information, etc.
3. "Mute Function" refers to the function that enables a User to restrict the receipt of messages sent between any User using the message posting function set forth in Article 4, Paragraph 2, Item 1, and to restrict the User from viewing any User's posts.
4. "Block Function" refers to the function that disables sending and receiving messages between any User using the Message Posting Function stipulated in Article 4, Paragraph 2, Item 1, and also restricts any User from using the Follow Function stipulated in Article 4, Paragraph 2, Item 2.
5. The "Drive function" is a function that allows you to manage files on this SNS.

Article 3 Contents of this SNS, additions, changes, etc.

1. This SNS is a SNS for communication between our company and users, and among users, with the aim of promoting the use of the services we operate and communication between users of the services we operate.
2. Users may use the functions set out below and any associated functions in accordance with the conditions set out by our company.
   1. Message posting function
   2. Follow feature
   3. Reaction feature to posts
   4. Mute function
   5. Blocking feature
   6. Drive function (※)
      *This is a function that allows you to manage files on this SNS. Uploaded files (whether or not they are attached to a post) can be viewed by third parties on the Internet.
3. The Company reserves the right to change all or part of the service content of this SNS without prior notice to the User. In such case, the Company shall not be liable for any damage or consequences incurred by the User as a result of such change.

Article 4 Deletion of Xissmie Account by User

1. Users may delete their Xissmie account at any time by using the method separately specified by the Company on this SNS.
2. If a User deletes their Xissmie Account in accordance with the provisions of Paragraph 1 of this Article, the Company may, at its discretion, delete all information held by the User on the SNS, and the Company shall only be liable for any damages incurred by the User as a result thereof within the scope of Article 28 Paragraph 11 of the General Terms and Conditions (or, if Paragraph 11 does not apply, within the scope of Paragraph 13 of the same Article).
3. The Company shall be liable for any damages incurred by users in connection with the "Misskey" precautions in Article 1, Paragraph 2 when using this SNS only within the scope of Article 28, Paragraph 11 of the General Terms and Conditions (or within the scope of Paragraph 13 of the same article if Paragraph 11 does not apply).

Article 5 Posting

1. If the posted information includes information about the user or a third party, the user shall display the information about themselves or a third party at their own risk. The Company shall not be held responsible for any information exchanged between users using this SNS, or any actions or damages that may occur as a result thereof.
2. Users are responsible for backing up or saving any posted information, and the Company shall not be liable for any loss of posted information following the suspension or interruption of the provision of this SNS or the deletion of a Xissmie account.
3. Due to the nature of the service, where multiple users are displayed together on the timeline, it is not possible to set the "bot countermeasure (reCAPTCHA) function" that can be set on Xfolio when posting on this SNS. If users wish to take measures against bots, we recommend that they post their work after setting the "bot countermeasure (reCAPTCHA) function" on the posting function of Xfolio, and then share the link on this SNS. Article 6 Prohibited Acts

In addition to the prohibited acts set forth in the General Terms and Conditions, when using this SNS, Users are prohibited from making posts with the intent of buying, selling, or illegally acquiring personal information or the right to use accounts for internet services such as social network services.

Article 7 Restrictions on Use

1. If a User falls under or is likely to fall under any of the following items, the Company may immediately, without prior notice or warning, suspend provision of all or part of the SNS to that User and delete the User's Xissmie account.
   1. When any of the items in Article 6 (Prohibited Acts) apply, or when any provision of these Terms and Conditions is violated, or when instructions from the Company based on these Terms and Conditions are not followed
   2. When a user performs any of the following acts:
      1. Violent demands made against the Company or its employees
      2. Making unreasonable demands against the Company or its employees that go beyond the scope of legal responsibility
      3. Threatening or violent behavior toward the Company or its employees in relation to transactions
      4. Any act of spreading false rumours, using fraudulent means or force to damage the Company's credibility or to interfere with the Company's business
      5. Any act similar to the above
      6. When a petition for seizure, provisional seizure, provisional disposition, compulsory execution or auction has been filed, or when a demand has been received for non-payment of taxes and public dues.
      7. When a party suspends payments or becomes unable to make payments, or when a petition for bankruptcy proceedings, civil rehabilitation proceedings, corporate reorganization proceedings, special liquidation proceedings or other similar proceedings is filed or the party itself files such a petition.
      8. When the Company determines that it is inappropriate to provide this SNS

The Company shall not be liable for any damages or consequences incurred by the User or a third party as a result of the suspension of provision of the SNS, the deletion of the Xissmie account, the deletion of all or part of the relevant information, or any other measures set out in paragraph 1 of this Article pursuant to this Article.
3. The suspension or termination of the provision of this SNS under this Article shall in no way prevent our company from claiming damages against users.

Article 8 Prohibition of Transfer, etc.

1. Except when the User has obtained the prior written consent of the Company, the User may not transfer, have a third party transfer, or dispose of the status under the Service Agreement or the rights and obligations owed to the Company under the Service Agreement.

Supplementary provisions

These Individual Terms and Conditions will come into effect on March 17, 2025.
These Individual Terms and Conditions will also apply to any actions taken by Members prior to the enforcement of these Individual Terms and Conditions.
